## Overview

Turo has arranged for third-party motor insurance coverage with Baloise Assurances Luxembourg S.A.\* (Baloise). Protection plans address financial responsibility for damage to a host’s vehicle and Additional Services (like [Roadside Assistance](https://help.turo.com/roadside-assistance-france-guests-S1Gdaoqa3)). Guest responsibility for damage to a host’s vehicle is not insurance but a contractual agreement between the guest and Turo.

Protection plans are valid for trips starting in France and include travel across borders into [covered countries abroad](https://help.turo.com/driving-across-borders-r1rjLfrgi).

## Terms to know

* **Guest** \- Refers to the primary guest as set out in the trip reservation as well as to any additional named drivers.

* **Physical Damage** \- Any damage to the Vehicle, including Mechanical Damage and Interior Damage.

* **Related Costs** - These include all costs and fees resulting from damage of any kind to the Vehicle during the booked trip. Cost and fees include but are not limited to:

*   estimation or appraisal costs

*   storage fees

* towing fees (coverage limited to 200 € for all protection plans)

*   repair or replacement costs

*   registration or transfer taxes

* claims processing fees and all similar or associated costs or fees, minus any residual salvage value that’s collected.

* **Vehicle** \- Refers to the vehicle booked during the applicable reservation.

## Third-party Liability insurance

All protection plans include coverage under a third-party liability insurance policy issued to Turo by Baloise\*. The Baloise policy covers the guests’ legal liability when compensation is due to third-parties during the trip. The insurance policy covers your legal liability to pay compensation up to 100 000 000 € for damage to other people’s property (other than the Vehicle), 2 000 000 € in explosion/fire coverage, and is not capped in case of death or bodily injury to others.

## Financial responsibility for Physical Damage to the Vehicle

Protection plans made available on Turo address the primary Guest’s financial liability for any damage to the Vehicle that takes place during the reservation period.

### Guest responsibility

* The primary Guest must return the Vehicle on time and in the same condition it was in when they first received it.

* The primary Guest is financially responsible for all Physical Damage or theft to the Vehicle, as well as Related Costs. The primary Guest is financially responsible for all costs in connection or arising from the damage regardless of who is found to be at fault for the damage.

    * The claim processing fee is 90 €. In the event of an accident involving a third party, if the guest is not found to be at fault for the damages, we will reimburse the guest the precautionary amount charged once Turo's insurer successfully recovers the costs from the third party's insurer.

* For example, if there’s Physical Damage to the Vehicle during the period of the booked trip, the primary Guest will be financially liable for the costs of repair, and Related Costs.

**Mechanical or Interior Damage.** The contractual limitation of financial responsibility available under the Premier, Standard, and Limited protection plans doesn’t apply to damage caused to the interior of the Vehicle or mechanical damage caused during the trip (excluding normal wear and tear). Regardless of which protection plan the primary Guests chooses, the primary Guest is financially responsible for the full cost of the repairs or replacement, as well as Related Costs, for interior damage or mechanical damage caused during the trip.

**Important**: Wear and tear does not include windows cracked or chipped by stones or other debris.

Primary Guests can protect themselves against an allegation that damage to the Vehicle occurred during the period of the booked trip. To do so, they should document with photos the condition of the Vehicle, including any existing damage, at the start of the booked trip and upload these photos to the Turo app in the Trip Photos section of their reservation.

## Guest’s responsibility for damage to the Vehicle

Primary Guests can contractually limit the amount that they’re liable to pay out of their own pocket in the event there’s Physical Damage to the booked car. This is not insurance but a contractual agreement on the allocation of financial responsibility. Primary Guests may choose from three (3) plans.

1. **Premier plan**: Under the Premier plan, the primary Guest is covered  for Physical Damage to the reserved car during the reservation and any Related Costs, _subject to conditions and exclusions, see below_. However, the primary guest remains liable for the cost of repairs if found responsible for Mechanical or Interior damage to the host’s vehicle.

2. **Standard plan**: Under the Standard plan, the primary Guest’s liability for Physical Damage (other than Mechanical or Interior Damage) to the host’s vehicle during the reservation, plus Related Costs, is contractually limited to 250 €, _subject to conditions and exclusions, see below_. The primary guest  who is found to be responsible for Mechanical or Interior damage to the host’s vehicle remains fully financially responsible for the cost of repairs.

For trips in France, upon receipt of the host's claim Turo will, as a precautionary measure and before Turo's expert partner assess the damage, debit 250 € from the guest's payment card used to pay for the trip.

If the amount of damage, as determined by Turo's expert partner, exceeds 250 €, Turo will retain the 250 € and will send the expert's report together with check in and check out photos to the guest.If the amount of damage, as determined by Turo's expert partner, is less than 250 €, Turo will reimburse the guest the difference between 250 € and the determined amount and send to the guest the expert's report together with before and after trip photos.

3. **Limited plan**: Under this plan, the primary Guest’s liability for  Physical Damage to the host’s vehicle (other than Mechanical or Interior Damage) to the reserved car during the reservation, plus Related Costs, is contractually limited to 3 000 €, subject to conditions and exclusions, see below.The primary guest who is found to be responsible for Mechanical or Interior damage to the host’s vehicle remains fully financially responsible for the cost of repairs.

For trips in France, upon receipt of the host's claim Turo will, as a precautionary measure and before Turo's expert partner assess the damage, debit 500 € from the guest's payment card used to pay for the trip.

If the amount of damage, as determined by Turo's expert partner, is less than 500 €, Turo will reimburse the guest the difference between 500 € and the determined amount . Turo will send the expert's report with check in and check out photos to the guest.

If the amount of damage, as determined by Turo’s expert partner, exceeds 500 €, Turo will deduct the difference between 500 € and the determined amount from the guest's payment card, up to a maximum of 3000 €.

The contractual limitation of liability included in the Premier, Standard, and Limited protection plans:

*   **only** apply if the primary Guest and each approved secondary driver abides by the [Terms of Service](https://turo.com/us/en/policies/terms);

* **only** apply to the amount the primary Guest is obligated to pay; and

* **only** apply to Physical Damage excluding Mechanical or Interior Damage.

## Important considerations

### Coverage via credit card

Don’t assume that your personal auto insurance policy or credit card coverage applies to person-to-person car sharing trip bookings in the same way it applies to traditional rental car bookings. [Get more information about credit card coverage.](https://help.turo.com/insurance-or-coverage-via-a-credit-card-rklgH4g45)

### Terms of Service violations, prohibited uses and exclusions

In addition to the exclusion of mechanical and interior damage, for the Premier, Standard, and Limited plans, if the Guest or any of their additional drivers violate the [Terms of Service](https://turo.com/us/en/policies/terms), engages in any [Prohibited uses](https://help.turo.com/prohibited-uses-Hyi0E4l49) or otherwise intentionally, recklessly, or with wanton disregard, misuse the car, the contractual limitation of liability is voided and does not apply. That means that the primary Guest will be fully liable for Physical Damage up to the actual value of the car, in addition to all Related Costs.
