## About host protection

Protection plans proposed to hosts to cover the costs of damages related to total loss or theft of a vehicle less any out-of-pocket† which applies (up to the appraised value of the vehicle, up to a maximum of 150,000 €). However, mechanical failures, regardless of their origin, are not covered.

Turo contractually covers the host's vehicle up to the amount of the deductible† applied by the partner insurer Baloise Assurances Luxembourg S.A.\* (Baloise), i.e. 3,000 € for Physical Damage and 25,000 € in the event of theft, hijacking or Physical damage with late return. The partner insurer Baloise covers third-party liability, bodily injury and Physical Damage from 3,000, and covers theft, hijacking and Physical Damage with late return from 25,000 €. The protection of the plans proposed to hosts will be refused in the event of non-compliance with the Conditions of Service,the insurance conditions and/or if elements are missing from the claim declaration. In this case, the host will not receive any compensation from Baloise or Turo. Contractual protection in the event of theft, vehicle hijacking or Physical Damage accompanied by a late return will be refused if the host has not complied with the Tracker policy. In this case, the Host will be subject to Baloise's deductible† of 25,000 € and will only receive compensation for amounts exceeding this deductible† amount.

You can choose a plan for your vehicle when you create your listing and change your plan any time. If you have more than one vehicle listed, you can choose different plans for each.

Hosts whose vehicles are registered outside of France or Hosts who offer to begin a trip or deliver a vehicle outside of France cannot benefit from the protection plans.

The level of available payment for repairs or reimbursement varies with the plan you choose. To be covered for Physical Damage, the host must provide Turo with time-stamped photos clearly showing the areas affected by the claim. These photos must have been taken within a maximum of 24 hours before the start of the trip and 24 hours after the end of the trip. The host must also provide a set of documents detailed [here](https://help.turo.com/fr/regler-une-reclamation-en-soumettant-une-demande-d%27indemnisation-or-hotes-en-france-ryg1XwW6h). If any item is missing, coverage will be denied.

IMPORTANT: Vehicles valued at 25,000 € or more and vehicles less than six years old must be equipped with a tracker, and Turo and its trusted partners must have access to location data in the event of theft, vehicle hijacking or late return. In the event of failure to comply with the [Tracker policy](https://help.turo.com/tracker-policy-france-hosts-rk4D_2gXxl), the host will have an out-of-pocket† of 25,000 €, whatever the  protection plan chosen.

**Note:** If you use a remote key exchange solution, you must secure any key left inside your car inside a lockbox and, where applicable, change the pin code after each trip. Failure to do so may result in reimbursement being refused.

**Note:** You must cooperate with Turo and its trusted third-party vehicle recovery service providers if a vehicle is reported stolen or missing or in the event  of a late return (e.g., the véhicule was not returned within 30 minutes of the scheduled end of the trip).

**IMPORTANT: Vehicles valued at 25,000** € **or more, or less than 6 years old, must be fitted with a tracker (or have an OEM tracker installed) and have the right to access Turo's location data in the event of theft or late return.** The host will have an out-of-pocket† of up to 25,000 € in the event of failure to comply with the [Tracker policy](https://help.turo.com/fr/politique-sur-les-traceurs-htes-en-france-rk4D_2gXxl).

## Detailed terms and conditions

So long as a Host is in compliance with the [Terms of Service](https://turo.com/us/en/policies/terms) and has properly secured the vehicle key as noted above, the following applies:

## Liability insurance

Liability insurance and vehicle damage protection are provided under a policy issued to Turo by Baloise. Terms, conditions, and exclusions apply (To find out more about Baloise's insurance terms and conditions, click [here](https://support-resources.turo.com/policies/FR%20Insurance%20Notice.pdf) and [here](https://support-resources.turo.com/policies/FR%20DIPA.pdf)).For all host protection plans bodily injury liability coverage is unlimited, property damage liability coverage is up to 100,000,000 €, and fire and explosion liability coverage is up to 2,000,000 € for all host protection plans.

Baloise covers eligible physical damage costs in excess of the applicable out-of-pocket†, subject to the admissibility of the claim and conditions and exclusions, for the lesser of the cost of repair up to the actual cash value of the vehicle or 150,000 €.

The protection plans do not cover the Delivery Period and there is no third-party liability insurance or protection for physical damage to the Host’s car during the Delivery Period; the Host’s personal insurance policy is in effect during the Delivery Period.

## Physical Damage reimbursement for or payment of repairs

The Host protection plans in France address how Turo and its insurance partner will cover the costs of Physical Damage to your car during the trip – whether by reimbursing you for repairs you arrange or covering the costs of repairs with an approved garage – subject to any out-of-pocket† in the plan you choose. Damage reimbursements under 25,000 € and our insurance partner, Baloise, will handle damage reimbursements from 25,000 €.

Turo, or in some cases our insurance partner, will reimburse Hosts for eligible Physical Damage costs above the out-of-pocket† of the protection plan – up to the lesser of the vehicle's appraised value and 150,000 €. If your car is lost or stolen, or if the Physical Damage costs make repair uneconomical, reimbursement will be the vehicle's appraised value  or 150,000 € (whichever is less). **Turo is NOT an insurance company**.

*   ****Out-of-pocket.****
    *   **

        For Vehicles on the 80 plan, there is no out-of-pocket†.

        **
    *   **For Vehicles on the 85 plan, there is a maximum 500 € out-of-pocket†.**
    *   **For Vehicles on the 90 plan, there is a maximum 1000 € out-of-pocket†.**
* **Diminished value.** If your car is damaged (not totaled/written off) and repaired, you’re not protected for any reduction in the value of your car. If your car is eligible for physical damage reimbursement protection, you will receive eligible costs up to the vehicle's appraised value, capped at 150,000 €. However, there is no reimbursement for any potential reduction in value resulting from damage related to a trip.

* **Mechanical failure.** Mechanical failures, regardless of their origin, are in no way covered by Turo and are not eligible for coverage by the partner insurer.

* **IMPORTANT: Theft, hijacking and late returns.** Baloise's partner insurer will step in with an out-of-pocket† of 25,000 €. Regardless of the protection plan chosen, this out-of-pocket† will be applied for certain vehicles if a tracker has not been installed and activated and if the host does not give Turo and its trusted partners access to the vehicle's location data. See detailed conditions [here](https://help.turo.com/fr/politique-sur-les-traceurs-htes-en-france-rk4D_2gXxl).

* **Quality of repairs.** Where you select your own garage for repairs, there is no guarantee, expressed or implied, for the quality of repairs. If a shop you choose repairs the covered damage and the repairs later turn out to be of low quality, there will be no reimbursement by Turo for repeat repairs. If you use a garage from Turo’s partner network  and the repairs are of low quality, Turo will reimburse you for reasonable costs of any repeat repairs. However, Turo will not reimburse any subsequent repairs you choose to have done by a repairer out of the partner  network unless an agreement has been reached to reimburse these costs.

*   **

    **Storage Fees**

    **
    * Turo will only reimburse you for **reasonable** Storage Fees, up to the prevailing rates in the market, and never more than 1,000 € unless Turo causes a delay that results in additional Storage Fees or as otherwise agreed in writing.

    * You must mitigate your costs and make sure Storage Fees or other expenses aren’t accumulating needlessly. The charges must be reasonable. If Turo informs you that it’s reached an impasse with your repair shop, auto body shop, or tow yard regarding how much Turo will reimburse you, you must promptly remove your vehicle before additional Storage Fees accrue. If you fail to do so, Turo will consider these Storage Fees as Unreasonable Charges and will be charged to you.

    * You’ll be responsible for paying additional amounts when your repair or auto body shop includes charges on the invoice above what Turo or its third-party claims handlers have agreed to reimburse under your protection plan, or it may be deducted from the amount you receive from Turo.

    * Turo will **only** reimburse you for Storage Fees subject to the limitations mentioned above. We won’t reimburse you for Storage Fees that accrue before the vehicle is deemed a total loss or that result from delays for which Turo isn’t responsible (e.g., delays caused by you or your repair or auto body shop).

The allocation of responsibility between Turo and the Host is not impacted or altered in any manner by any amount that Turo can or does collect from the Primary Guest or a third party on account of the Physical Damage. The Host’s plan is unrelated to the level of responsibility retained by the Primary Guest under whichever Guest protection plan is chosen by the Primary Guest.

## Damage payment and value-added tax

If your vehicle is damaged, we’ll share a [list of garages](https://drive.google.com/file/d/1OKs4_taf2DS98SOEIpb8Hxp9OH8z5WVi/view?usp=sharing) from Turo’s partner network with you. If you have your vehicle repaired at one of these garages, we’ll issue payment (minus your out-of-pocket†), gross of VAT, to the garage. You must pay the out-of-pocket† amount directly to the garage to retrieve your car. If you are a private individual and you take the vehicle to a garage that is not part of our partner network, or if you prefer to receive cash instead, we will pay you the cost of repairs including VAT, less the out-of-pocket† of your protection plan. If you are a professional and you entrust the vehicle to a garage that is not part of our partner network, or if you prefer to receive cash instead, we will pay you the cost of repairs net of VAT, less the out-of-pocket† of your protection plan.

**Note:** The list of partner garages is not exhaustive and is subject to change at any time.

## General Definitions

●      **Comprehensive:** other Physical Damage to the car that isn’t a collision – theft, fire (excluding fires resulting from Mechanical Failure), animal impacts, vandalism, falling objects, and acts of nature (windstorm, flood, etc.). In the case of “acts of nature” or fire comprehensive damage (e.g., flood, earthquake, hail, windstorm, etc.), the Host will receive a reimbursement from Baloise minus the applicable out of pocket.

●      **Delivery Period:** the time when the Host or co-host is actively delivering the car to the primary guest who has reserved delivery and ends when the car has been delivered to the primary guest. The period doesn’t include the time when the Host or co-host is retrieving the car at the end of the trip. The protection plans do not apply during the Delivery Period and there is no third-party liability insurance or protection for physical damage to the Host’s car; the Host’s personal insurance policy is in effect during the Delivery Period.

●      **Deterioration:** any fading, discoloration, rust, or wear caused to the interior or exterior of the Vehicle over time. Also includes any deterioration from road use of tyres, and mechanical deterioration of belts, suspension, and electrical and mechanical components, along with any resulting damage from these events.

●      **Exterior Wear and Tear:** any dings, dents, cracks, or scratches to the exterior body of the Vehicle that is 7.5 cm in diameter or less. This includes, but is not limited to, rims, wheels, hubcaps, any painted or textured area for the body of the Vehicle, and moldings. Read more about [Wear and Tear.](https://help.turo.com/wear-and-tear-r11vU4l45)

●      **Guest:** the primary name listed in the reservation. We also use it to refer to any additional drivers named on the reservation.

●      **Host:** The person(s) or entity that lists a Vehicle on Turo, including the Vehicle owner(s) and persons or entities authorized by the Vehicle’s owner(s) to list the Vehicle on Turo.

●      **Interior Wear and Tear:** minor scuffing of interior surfaces that is 7.5 cm or less in diameter, along with any dials, switches, or knobs, that break or fail over time. Cuts and punctures that are clearly due to abuse or misuse by the Guest are not included in this definition.

●      **Mechanical Failure:** confined wear and tear or breakdown of mechanical components, which includes the vehicle’s electrical system, suspension, engine, or transmission. This includes any damage resulting from wear and tear, manufacturer defect, lack of maintenance or upkeep. Damages caused by accidents or shocks during a trip are excluded from mechanical failure. Clutch damage is handled separately. Read our [clutch policy](https://help.turo.com/clutch-repair-reimbursement-SJfvUNlEc).

●      **Necessary Repair Costs:** the reasonable and necessary costs for the parts and the labor required to repair the eligible Physical Damage to the reserved Vehicle that occurred during the Reservation Period, except for the following Excluded Costs:

○      If the Reimbursable Cause is a natural disaster (e.g., flood, earthquake, hail, windstorm, etc.), any cost that the Host’s private passenger auto insurer would not have been required to pay under the primary insurance policy covering the Vehicle in effect immediately before the start of the Reservation Period.

●      **Out-of-pocket:** the amount you are responsible for in the event of Physical Damage to your car during a Turo trip, in the event of hijacking or theft before you’re eligible for reimbursement†.

●     **Physical Damage:** actual tangible damage to the Vehicle that occurs after delivery during the Reservation Period as a result of a Collision or a Reimbursable Cause (Note: The Host is required to demonstrate that any damage to the reserved Vehicle meets the definition of Physical Damage by providing the proof outlined below).

○      Collision means when the Vehicle collides with another vehicle or an object.

○      Reimbursable Cause means theft, fire (excluding fires resulting from Mechanical Failure), animal impacts, vandalism, falling objects, and acts of nature (e.g., flood, earthquake, hail, windstorm, etc.).

○      Excluded Damage:

■      Damage existing as of the start of the Reservation Period;

■      Interior Wear and Tear;

■      Exterior Wear and Tear;

■      Physical Damage existing before or occurring during the Delivery Period;

■      Deterioration;

■      Mechanical Failures

■      Physical Damage that occurs during or after any period in which the Host violates the Terms of Service and other Turo policies;

■      Damage to any personal items left in the Vehicle;

■      Damage to, or resulting from, tyres that are defective, have excessive wear & tear or mold, have tread depth less than 3.175 mm, were not properly inflated before the reservation, or are 6 or more years old.

■      Dings, dents, scratches, and creases less than 7.5 cm to the inside of truck beds from loading or carrying items.

●      **Reservation Period:** begins at the trip start time listed in the reservation and when the Vehicle is in the custody or control of the Guest and ends the earlier of the trip end time or when the Vehicle is returned to either the Host or the location designated in the reservation. This is the period shown for a booked trip. Please visit [here](https://help.turo.com/reporting-a-late-return-H15iBExV5) to learn more about what qualifies and what to do in the event of a late return.

    * (1) [clear, time-stamped photos of the areas concerned](https://help.turo.com/en_us/taking-damage-photos-Hk6tLVlN5) by the claim taken by the host 24 hours before trip start and uploaded up to 24 hours after trip start _and_ taken and uploaded by the host up to 24 hours after trip end; **or**

    * (2) other solid evidence (e.g., a police report) that demonstrates the damage took place during the trip

**Note:** Payments and reimbursements are made by either Hyperwallet or PayPal.

## Police complaint requirements

Neither a simple report log (_main courante_) nor an online pre-complaint (_pré-plainte en ligne_) constitute a valid police complaint. A pré-plainte en ligne is merely a preliminary declaration and has no legal effect unless it is duly formalized in person before a law enforcement officer. The submission of either a main courante or a pré-plainte en ligne alone is insufficient and will result in the exclusion or denial of reimbursement under the applicable protection plan. Pursuant to Article 15-3 of the French penal procedure code (_code de procédure pénale_), law enforcement authorities are legally bound to receive and record any formal police complaint and may not refuse its registration. You must provide Turo, without delay, with a complete and legible copy of the formal police complaint, including all pages (_feuillets_) comprising the procedure. This must include:

* the minutes of the formal interview (_PV_) conducted by the Agent de Police Judiciaire (_APJ_) or Officier de Police Judiciaire (_OPJ_) who received the complaint; and

* the receipt (_récépissé_) evidencing the effective registration of the complaint.

\*Baloise Assurances Luxembourg S.A., a Luxembourg société anonyme (private limited company) having its registered office at 8 rue du Château d'Eau, L-3364 Leudelange, Grand Duchy of Luxembourg, acting in France under Freedom to Provide Services and registered with the Luxembourg Register of Commerce and Companies (R.C.S. Luxembourg) under the number B68065.

\*\*To be covered, hosts must comply with the Turo [Terms of Service](https://turo.com/ca/fr/reglements/conditions) and provide all the information required to process the claim.

†We use the expression “out-of-pocket” to mean the amount you are responsible for in the event of physical damage, hijacking or theft to your car during a Turo trip before you’re eligible for reimbursement. Turo, or its insurance partner, will be responsible for reimbursement beyond your out-of-pocket. That means that if, for example, a Turo guest damages your car, you will be reimbursed directly by Turo or by the partner insurer for the cost of repairing the damage (up to the appraised value of the vehicle, capped at 150,000 €), less the applicable out-of-pocket (see IMPORTANT for cases where the out-of-pocket expenses will be 25,000 €).
